Aftonbladets ledarsida legitimerar Anders Lindberg USA:s m.fl. raketanfall på Syrien.

Denna inställning öppnar upp för anarki och gör FN-stadgans våldsförbud meningslöst, vilket två av USA:s främsta folkrättsjurister just har påpekat:

”The ’illegal but legitimate’ defense has been tossed around since Kosovo.  It is often presented as a legal argument, but it is not. It is a claim that illegal behavior can nonetheless, in some circumstances, be legitimate. But legitimacy is in the eye of the beholder. If ’illegal but legitimate’ becomes an accepted principle, then the Charter’s limits become meaningless. Nations that do not share Western conceptions of legitimacy could justify uses of force based on their own conceptions of legitimacy. In short, ’illegal but legitimate’ implies no legal limits on the use of force.”

Lindbergs rättfärdiggörande av anarki bör mötas med ett kraftfullt avståndstagande.

Som framgår av bifogade länk pågår ett uppror bland amerikanska folkrättssakkunniga. De underkänner en argumentation som försvararna av västmaktsbombningarna, däribland USA:s försvarsminister, gärna tillgriper.

As we  before Trump’s announcement, there is no apparent domestic or international legal authority for the strikes. Although the United States has not offered a formal legal argument, a number of legal theories have been floated in recent days. We address them each briefly here. […]

The strike is necessary to enforce the prohibition on the use of chemical weapons. Each of the leaders of the three states that carried out the strikes last night—Trump, U.K. Prime Minister Theresa May, and President Emmanuel Macron of France—made some version of this argument in their statements to the public announcing the strikes. The problem with this argument is that the 1997 Chemical Weapons Convention, which is the central international legal instrument on the topic, provides an enforcement system that the three powers involved in last night’s airstrikes entirely bypassed. The Convention provides, first, for investigation by the experts from the Organization for the Prohibition of Chemical Weapons—who were due to begin their investigation today (the OPCW has announced the deployment will proceed, though it is not clear if it will be delayed). Then, in situations of “particular gravity,” the Conference of the States Parties may bring a matter to the attention of the U.N. General Assembly and Security Council. Nowhere does the Convention provide for unilateral uses of force in response to a breach of the Convention. And if it had, there’s a good chance no state would ever have joined it. And putting the treaty to one side, there is no reason at all to think that any related “norm” prohibiting the use of chemical weapons can be enforced with force outside the Charter framework. Almost two years have passed since Sir John Chilcot produced his 12-volume report on the lessons of the Iraq war.

We collectively promised to learn the lessons.

Last weekend it was as if the Chilcot report never happened. Britain, cheered on by a bellicose press and a largely docile Parliament, launched airstrikes that showed the same disregard for due process against which Chilcot warned. Remember what Chilcot told us: ‘The judgements about the severity of the threat posed by Iraq’s weapons of mass destruction – WMD – were presented with a certainty that was not justified.’[…]

It‘s true that Russia blocked a proposal to create a new joint UN OPCW investigative mechanism which would have a new and broader mandate to apportion blame for any attack it concluded had happened. But it was actually Syria and Russia who asked for the OPCW fact-finding mission.

This is extremely significant. Had we wanted independent verification on this occasion in Syria surely we ourselves would have demanded the OPCW send a mission to Douma. Yet we conspicuously omitted to ask for it.[…]

There are also question marks around the veracity of British and American assertions about the bombing raids. The US said it struck three known chemical weapons facilities in Syria – including at Barzeh and Jamraya outside Damascus. Yet the OPCW itself found these sites to have no chemical weapons as recently as last November.

In order to help prove the existence of chemical weapons, Theresa May said in her statement to Parliament on Monday that Asad’s helicopters were operating over Douma shortly before reports of a chemical weapons attack emerged. This was true, but completely irrelevant. Nobody disputes that bombings was occurring and that helicopters were in the area. The real question is, what was the payload? The alternative explanation of the incident offered by the Syrians is that conventional bombing caused it. The presence of helicopters is consistent with this explanation. Läs artikel

FMV beställer nytt ledningsstödsystem, fmv.se

FMV har beställt ett nytt ledningsstödsystem till Försvarsmakten inför marinens kommande deltagande i Nato Response Force, NRF, under 2019.

Beställningen omfattar totalt fyra system:

  • två fartygssystem
  • ett utbildningssystem
  • ett landbaserat system

Detta ledningsstödsystem ska fungera i en internationell miljö för att planera och genomföra marina uppdrag tillsammans med andra nationer. I samband med detta har även en beställning gjorts på vidmakthållande av systemet under 2 år.

Ordervärdet är cirka 80 miljoner. Läs pressmeddelande

Historisk set er der intet nyt under solen i det nye forsvarsforlig. Hovedambitionen er at få forsikringspolicen i Nato så billigt som muligt. Konsekvensen bliver konstante kompensationsudsendelser i tillæg til de nye afskrækkelsesmissioner, der vil presse personel og materiel hårdere, end godt er. […]

Forsvaret vil med forøgelsen af budgettet i det nye forlig ikke kunne løse begge opgaver samtidigt. Der er ressourcer nok til at støtte Nato-afskrækkelsen af russerne, men kapaciteten til også at støtte amerikanskledede operationer bliver forsvindende lille. Det er ikke noget problem for dansk militær sikkerhed. Danmark vil ikke blive angrebet udefra, så længe Nato består. Men det bliver et problem for forsvaret, fordi politikerne har svært ved at sige nej til USA. De vil presse personellet og materiellet til det yderste for at fastholde den goodwill og særbehandling, som de har vænnet sig til. Når telefonen ringer fra USA, vil Forsvaret også fremover blive bedt om at stille op. Det gør det hårdt at være forsvarschef, da man skal have hår nok på brystet til at sige fra, når politikerne forlanger indsættelser, der ikke er kapacitet til. Kommittén (EESK) är fast övertygad om att det är nödvändigt att bygga upp en stark nyckelkapacitet för att stödja europeiska intressen. Denna måste fastställas av medlemsstaterna i enlighet med deras nationella försvarspolitik, europeiska mål och de skyldigheter som Natopartnerskapet medför. […]

När det gäller riktmärken är det viktigt att se den övergripande bilden, vilket innebär att man inte bara bör beakta medlemsstaternas nationella forskningsprogram utan också den utveckling som våra Nato-partner ligger bakom på olika områden.

EESK välkomnar att man utvecklar gemensamma standarder, och samtidigt undviker överlappningar mellan befintliga standarder, särskilt Natos. Med 178 olika identifierade vapensystem i Europa skulle en forskningsprioritering vara att fastställa gemensamma europeiska standarder och gränssnitt för att koppla samman de befintliga standarderna och gränssnitten så mycket som möjligt och förbereda de framtida systemen. Genom att följa sådana standarder skulle medlemsstaterna få råd att utveckla lösningar som är kompatibla i hela Europa. Läs artikel

Tirsdag kveld kom Forsvarsdepartementet med en pressemelding som gjør det klart at Evenes flystasjon også skal brukes i såkalte høyintensitetssituasjoner. Sagt med andre ord: I krig. […]

Departementet har også presisert behovet for luftvern, et stadig tilbakevendende spørsmål knyttet til valg av Evenes som enebase.

– Evnen til å drive luftoperasjoner med F-35 og maritime patruljefly må understøttes og beskyttes fra baser. Kampfly og maritime patruljefly er sårbare når de står på bakken. Luftvern er et aktivt beskyttelsestiltak mot luftangrep, også fra langtrekkende presisjons­våpen. Luftvern er således viktig for Forsvarets evne til å drive luftoperasjoner i krise og væpnet konflikt. Läs artikel

 

Norges milits kriger mot Assad, klassekampen.no

 Norge skulle trene syriske opprørere til kamp mot Den islamske staten (IS). Nå kriger opprørerne mot regimet. Assad er hovedmålet, sier militsleder Muhannad al-Talla.

En opprørsmilits i Syria som Norge har trent og kriget med i kampen Den islamske staten (IS), har også vært i kamper med regimevennlige styrker. Nå kjemper militsen, som kaller seg Den revolusjonære kommandohæren (MaT), for regimeendring i Damaskus. Gruppa er også en viktig brikke i USAs kamp for å hindre iransk innflytelse i regionen. Det bekrefter flere syriske opprørskilder, inkludert øverstkommanderende for militsen, overfor Klassekampen.

I mai 2016 varslet Norge at norske soldater skulle sendes til Syrias naboland Jordan for å gi «trening, rådgiving og operativ støtte» til syriske opprørere i kampen mot IS. Oppdraget var del av den USA-ledede Operation Inherent Resolve. I juni samme år ga Stortinget grønt lys til at de norske soldatene også kunne rykke inn i Syria som del av oppdraget. Muhannad al-Talla, øverstkommanderende i militsen MaT, sier i dag at hans gruppe ble trent av nordmenn i Tanf sørøst i Syria, der USA har en base.

In 16 years, the Organisation for the Prohibition of Chemical Weapons has overseen the destruction of over 80% of declared stockpiles. […]

The absence of publicity has helped the OPCW go about its business with a quiet but striking efficiency. Since its founding in 1997, it has overseen the elimination of over 80% of the world’s declared chemical weapons stocks, starting with a bunker full of mustard gas and arsenic-based chemicals left behind by the communist regime in Albania.

The entire stockpiles of India and South Korea have also been destroyed, as well as almost all of Muammar Gaddafi’s stocks in Libya, and well over 90% of the vast US arsenal. Russia’s – an ever bigger relic from the cold war – is two-thirds of the way to oblivion, and the OPCW is working on dismantling weapons left behind by Japan’s wartime occupation of China.

In terms of disarmament it is one of the world’s biggest achievements. Almost a century ago, in the trenches of the first world war, chemical munitions threatened to be the harbingers of an awful future. Saddam Hussein’s use of them against Iran and then against Kurdish civilians in Halabja in 1988 were a reminder of their indiscriminate nature, as were the haunting pictures of rows of white-shrouded corpses of children after the attacks in Ghouta, Damascus, in August. När Norge var på väg att ansluta sig till Atlantpakten gjorde Sovjetunionen vissa försök att påverka processen. Den sovjetiske ambassadören översände i slutet av januari 1949 en förklaring, i vilken han anmodade Norge att klargöra sin inställning. Han hänvisade till att Norge hade gemensam gräns med Sovjetunionen, och han ville ha besked om huruvida den norska regeringen ämnade påta sig några förpliktelser när det gällde placering av luft- eller sjömilitära baser på landets territorium.Den norska regeringen bekräftade i sitt svar den 1 februari 1949 att den avsåg att undersöka och klargöra i vilka former och på vilka villkor Norge kunde komma att delta i Atlantpakten. En filosofs avfärdande av ”interventionistas” och humanitära interventioner

Nassim Nicholas Taleb är en av de mest inflytelserika filosoferna i nutid. I sin senaste bok, Skin in the Game (Random House 2018), skriver han om Libyen efter Antaeus :

”…Libya, the putative land of Antaeus, now has slave markets, as a result of a failed attempt at what is called ’regime change’ in order to ’remove a dictator’. Yes, in 2017, improvised slave markets in parking lots, where captured sub-Saharan Africans are sold to the highest bidders.

A collection of people classified as interventionistas (to name names of people operating at the time of writing: Bill Kristol, Thomas Friedman , and others) who promoted the Iraq invasion of 2003, as well as the removal of the Libyan leader in 2011, are advocating the imposition of additional such regime change on another batch of countries, which includes Syria, because it has a ‘dictator.’

These interventionistas and their friends in the U.S. State Department helped create, train, and support Islamist rebels, then ‘moderates’, but who eventually evolved to become part of al-Qada, the same, very same al-Qaeda that blew up the New York City towers during the events of September 11, 2001. They mysteriously failed to remember that al-Qaeda itself was composed of ‘moderate rebels’ created (or reared) by the U.S. to help fighting Soviet Russia because, as we will see, these educated people´s reasoning doesn´t entail such recursions.

So we tried that thing called regime change in Iraq, and failed miserably. We tried that again in Libya, and there are now active slave markets in the place. But we satisfied the objective of ‘removing a dictator.’ By the exact same reasoning, a doctor would inject a patient with ‘moderate cancer’ cells to improve his cholesterol numbers, and proudly claim victory after the patient is dead, particularly if the postmortem shows remarkable cholesterol readings.  But we know that doctors don´t inflict fatal ‘cures’ upon patients, or don´t do it in such a crude way, and there is a clear reason for that. Doctors usually have some modicum of skin in the game, a vague understanding of complex systems, and more than a couple of millennia of incremental ethics determining their conduct. “

 

Egen och oberoende svensk förmåga att bekämpa ballistiska missiler, riksdagen.se

Försvarsminister Peter Hultqvist: Allan Widman har frågat mig vilka åtgärder jag är beredd att vidta för att Sverige, genom anskaffning av nytt medelräckviddigt luftvärn, ska uppnå en egen och oberoende förmåga till bekämpning av ballistiska missiler. Regeringen bemyndigade den 7 november förra året Försvarets materielverk att skicka en förfrågan samt inleda förhandlingar avseende luftvärnssystemet Patriot. Patriotsystemet skulle i operativa termer ge Sverige en oberoende förmåga till bekämpning av taktiska ballistiska missiler. Sannolikheten för en framgångsrik bekämpning av sådana vapensystem ökar med tidig förvarning och god sensorinformation. Tidig förvarning kan härröra från nationella källor eller andra.

Allan Widman (L): Är egna nationella sensorer tillräckligt för att åstadkomma den träffsäkerhet som vi kan acceptera – ja eller nej? Den frågan, fru talman, borde den ytterst ansvarige för det militära försvaret i Sverige kunna besvara. Om svaret på frågan är nej, vill jag rikta följande uppmaning till regeringen, nämligen att innan man definitivt gör en anskaffning av Patriot ser till att vi får garantier nedskrivna i avtal som ger oss tillgång till de sensorer som vi behöver för att kunna verka effektivt med Patriot.
